SPAD Projects – Terms and Conditions of Trade

Introduction

These Terms and Conditions of Trade (“Terms”) govern the business relationship  between SPAD Projects (“SPAD Projects,” “we,” “our,” or “us”) and our clients (“you” or “your”),
regarding the provision of tiling, bathroom & laundry renovations, custom tiling,  new build tiling, and related services (“Services”). By engaging with or accepting our Services,
you agree to be bound by these Terms.

1. Services

1.1 SPAD Projects provides tiling services, including but not limited to:
✔ Bathroom & laundry renovations
✔ Custom tiling & feature walls
✔ New build tiling
✔ Floor & wall tiling solutions
1.2 The scope of work, including specifications, costs, and timelines, will be outlined in a
written agreement or proposal.

2. Quotations & Pricing

2.1 All quotations are valid for 30 days unless otherwise stated.
2.2 Prices quoted are exclusive of applicable taxes and fees unless explicitly mentioned.
2.3 SPAD Projects reserves the right to adjust pricing due to unforeseen circumstances,
scope changes, or additional work requested by the client.

3. Orders & Acceptance

3.1 To commence work, the client must provide written acceptance of SPAD Projects’
quotation or proposal.
3.2 Acceptance of a quote signifies agreement to these Terms and Conditions.
3.3 Changes to the scope of work must be agreed upon in writing by both parties.

4. Payment Terms

4.1 Payment terms will be specified in the quotation or proposal.
4.2 SPAD Projects reserves the right to request a deposit or advance payment before work
begins.
4.3 Invoices are due within the stipulated timeframe from the invoice date.
4.4 Late payments may incur interest fees as per applicable laws.

5. Delivery & Installation

5.1 Installation timelines will be agreed upon with the client.
5.2 SPAD Projects is not responsible for delays caused by external factors, including
weather conditions, supplier issues, or regulatory approvals.
5.3 Clients must ensure suitable access to the worksite for installation.

6. Warranties

6.1 SPAD Projects provides a 20-year workmanship warranty on all tiling projects unless
otherwise specified.
6.2 Warranties are void if work is tampered with, improperly maintained, or altered
outside manufacturer guidelines.

7. Limitation of Liability

7.1 SPAD Projects is not liable for indirect, incidental, or consequential damages arising
from the provision of Services.
7.2 Our liability for any claim, including breach of contract or warranty, is limited to the
amount paid for the specific service.

8. Termination

8.1 Either party may terminate the agreement with written notice if the other party breaches
these Terms and fails to rectify the breach within a reasonable period.
8.2 Termination does not relieve the client’s obligation to pay for work already completed
or expenses incurred by SPAD Projects.

9. Governing Law

These Terms and the business relationship between SPAD Projects and the client are
governed by the laws of South Australia.

10. Cancellation & Refund Policy

10.1 Cancellation by the Client: Clients must provide written notice if they wish to cancel
an order.
● Cancellations within 48 hours of acceptance receive a full refund of any deposits
paid.
● Cancellations after 48 hours may incur a cancellation fee as outlined in the
quotation or proposal.
10.2 Cancellation by SPAD Projects:
● SPAD Projects reserves the right to cancel any order. In such cases, a full refund
of any payments received will be provided.
10.3 Refunds:
● Refunds will be processed within 14 days of cancellation.
● Refunds will be made using the original payment method, unless otherwise agreed
upon.
